Durante a aprova\u00e7\u00e3o da Resolu\u00e7\u00e3o CNJ n\u00ba 586\/2024, o Ministro Lu\u00eds Roberto Barroso apresentou dados que destacam essas varia\u00e7\u00f5es nos \u00faltimos anos:<\/p>\n<ul>\n<li><strong>2017:<\/strong> 5,5 milh\u00f5es de processos pendentes.<\/li>\n<li><strong>2018:<\/strong> Redu\u00e7\u00e3o para 4,9 milh\u00f5es.<\/li>\n<li><strong>2019:<\/strong> Queda para 4,5 milh\u00f5es.<\/li>\n<li><strong>2020:<\/strong> Aumento para 5,7 milh\u00f5es.<\/li>\n<li><strong>2021:<\/strong> Estabilidade em 5,6 milh\u00f5es.<\/li>\n<li><strong>2022 e 2023:<\/strong> 5,4 milh\u00f5es.<\/li>\n<\/ul>\n<p>Com a reforma trabalhista de 2017, esperava-se que os acordos extrajudiciais trouxessem mais seguran\u00e7a e agilidade para empresas e trabalhadores. Contudo, a falta de previs\u00e3o legal sobre a quita\u00e7\u00e3o ampla, geral e irrevog\u00e1vel dos acordos gerou incertezas. Na pr\u00e1tica, muitos ju\u00edzes hesitavam em homologar tais acordos devido \u00e0 aus\u00eancia de respaldo legislativo, deixando as empresas vulner\u00e1veis a futuros lit\u00edgios, j\u00e1 que quest\u00f5es n\u00e3o mencionadas poderiam ser rediscutidas. Esse cen\u00e1rio reduziu a efici\u00eancia e o uso dos acordos extrajudiciais.<\/p>\n<p>A Resolu\u00e7\u00e3o CNJ n\u00ba 586, de 30 de setembro de 2024, surge como um avan\u00e7o nesse contexto, buscando aumentar a efic\u00e1cia dos acordos extrajudiciais e fortalecer os Centros Judici\u00e1rios de M\u00e9todos Consensuais de Solu\u00e7\u00e3o de Disputas (Cejuscs-JT). A resolu\u00e7\u00e3o estabelece regras claras para os acordos homologados pela Justi\u00e7a do Trabalho, incluindo:<\/p>\n<ul>\n<li>Previs\u00e3o expressa de quita\u00e7\u00e3o ampla, geral e irrevog\u00e1vel.<\/li>\n<li>Assist\u00eancia por advogados constitu\u00eddos ou sindicato, <strong>vedando-se a constitui\u00e7\u00e3o de advogado comum para ambas as partes<\/strong>.<\/li>\n<li>Assist\u00eancia especial para trabalhadores menores de 16 anos ou incapazes, com pais, curadores ou tutores legais.<\/li>\n<li>Aus\u00eancia de v\u00edcios de vontade ou defeitos, conforme os artigos 138 a 184 do C\u00f3digo Civil.<\/li>\n<\/ul>\n<p>Al\u00e9m disso, a resolu\u00e7\u00e3o delimita situa\u00e7\u00f5es em que a quita\u00e7\u00e3o do acordo n\u00e3o se aplica, protegendo direitos que n\u00e3o podem ser objeto de quita\u00e7\u00e3o ampla. Essas situa\u00e7\u00f5es incluem:<\/p>\n<ul>\n<li>Sequelas acident\u00e1rias ou doen\u00e7as ocupacionais ignoradas ou n\u00e3o especificadas no acordo.<\/li>\n<li>Fatos e\/ou direitos que as partes desconheciam no momento da celebra\u00e7\u00e3o do acordo.<\/li>\n<li>Partes que n\u00e3o foram representadas ou substitu\u00eddas no acordo.<\/li>\n<li>T\u00edtulos e valores expressamente ressalvados.<\/li>\n<\/ul>\n<p>Nos primeiros seis meses, a resolu\u00e7\u00e3o se aplica a acordos superiores a 40 sal\u00e1rios-m\u00ednimos, como forma de avaliar seu impacto.<\/p>\n<p>A Resolu\u00e7\u00e3o CNJ n\u00ba 586\/2024 marca um avan\u00e7o significativo na promo\u00e7\u00e3o dos m\u00e9todos consensuais para resolver conflitos trabalhistas. Ao fortalecer os Cejuscs-JT e definir crit\u00e9rios claros para a homologa\u00e7\u00e3o de acordos, ela busca n\u00e3o apenas reduzir a litigiosidade, mas tamb\u00e9m proporcionar solu\u00e7\u00f5es mais r\u00e1pidas e justas.
